The instant application under section 528 B.N.S.S. has been preferred by the applicant with a prayer to quash the order dated 28.01.2025 passed by learned Chief Judicial Magistrate, Pratapgarh whereby the remand application of the petitioner was allowed till 10.02.2025 in Case Crime No. 187 of 2024, under Sections 111(2)(b), 303(2), 329(3) BNS, Police Station Manikpur, District Pratapgarh. At the outset, on the matter being taken up, learned counsel for the applicant submits that the petitioner does not want to press this application, therefore, he may be allowed to withdraw this application. Learned A.G.A. has no objection to such prayer of the applicant. In view of the above, the instant application is dismissed as withdrawn. However, it is made clear that in case petitioner is advised to challenge the subsequent order of his remand, this order will not come in the way of deciding the same on its merit.
