This Application has been filed for anticipatory bail in Case Crime No.577 of 2025, registered at Kotwali Jwalapur, District Haridwar under Sections 316, 318(4) and Section 351(2) of the Bharatiya Nyaya Sanhita, 2023.

Heard Mr. Parikshit Saini, learned counsel for the applicants and Mr. Pradeep Lohani, learned Brief Holder for the respondent.

Learned counsel for the respondent has relied on a judgment of the Hon’ble Supreme Court, passed in
“Jagdeo Prasad vs. State of Bihar and Others”, 2025 SCC OnLine SC 2108.

Mr. Parikshit Saini, Advocate, has been asked by this Court why the applicants did not approach the Sessions Court first. In reply, he has relied on an Order 1
2025:UHC:9311 of the Hon’ble Supreme Court, passed in Special Leave to Appeal (Crl.) No(s) 6588 of 2025,
“Mohammed Rasal .C and Another vs. State of Kerala and Another”,. The Hon’ble Supreme Court has fixed 12.11.2025 in the said matter.

Mr. Parikshit Saini, Advocate, has not been able to show any special circumstances.

Accordingly, the present Application, filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is disposed of, with a direction to the applicants to approach the Sessions Court first.
