In view of the proposed order being passed, notices to respondent Nos.2 to 6 are dispensed with. This criminal appeal has been filed by the appellant under Section 14A (2) the Schedule Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 to set aside the order dated 18.11.2024 passed in Criminal Misc. Case no.180/2024 by the Additional Session Judge/Special Judge, SC/ST (PA) Act, Ayodhya. The operative part of the order is extracted below:- "5. ससनन तथन पतनवलल कन अवललकन ककयन। पनथरनन पत कक कथनन सक हल यह सपष हह कक पनरथरनल कन कवपकलगण सक भभकम ससबसधल कववनद हह जल रसकवल पकक कत कन कववनद हह। इस कववनद कक ससबसध मम कवपकलगण कक ओर सक आवककदकन कक कवरद मनरपलट कन एक मसकदमन कदननसक 22.12.2023 कल थननक मम पसजलकक त करनयन थन। ऐसन पतलत हलतन हह कक उसकक बनद कदननसक 01.01.2024 कक घटनन बननकर कवपकलगण कक कवरद पथम सभचनन ररपलटर दजर करननक कक रलए यह पनथरनन पत उस मसकदमक कल कनउनटर करनक और कवपकलगण पर दबनव बनननक कक रलए पसतसत ककयन गयन हह। 5-5 कवपकलगणन दनरन आवककदकन कल लनत, मभकल और थपपडन सक मनरनक कक बनत कहल गई हह। कलई इनजरल ररपलटर पसतसत नहह कक गई हह, न हल यह बतनयन गयन हह कक कहनस चलटम आई थल। घटनन कदननसक 01.01.2024 कक कहल गई हह। वररष पसरलस अधलकक कल पनथरनन पत घटनन कक पनदह कदन बनद 16.01.2024 कल कदयन गयन हह और इस कवलसब कन कलई सपषलकरण पसतसत नहह ककयन गयन हह। नयनयनलय मम पनथरनन पत दस महलनक बनद कदननसक 02.10.2024 कल पसतसत ककयन गयन हह। समसत तथयल एवस पररससथकतयन मम पनथरनन पत सवलकनर हलनक यलगय नहह हह। आदकश पनरथरनल रमकलन दनरन पसतसत पनथरनन पत अनतगरत धनरन 173 (4) बल. एन. एस. एस. कनरसत ककयन जनतन हह। पतनवलल बनद आवशयक कनयरवनहल दनरखल दफतर हल। " Upon a query being made from the learned counsel for the appellant, he could not show any medical report or injury report. He could not even tell at which part of the body the victim received injuries. The incident is said to have taken place on 01.01.2024 however, the application has been given on 16.01.2024 to the Superintendent of Police. No reason for this delay has been explained. It also appears that earlier the accused has lodged a criminal case against the present appellant. Considering these aspects, the impugned order appears to have been been passed thus, I do not find any illegality in the order impugned, the revision being devoid of merits is accordingly dismissed.
