Through this application the applicant has prayed for quashing of the order dated 24.1.2023 passed by the Presiding Officer, Additional Court, Room No.4, Lucknow in Complaint Case under Section 138 of the N.I.Act, 1881 bearing Complaint No.2440 of 2018, Vijaya Bank vs. Sanjay Rawat. Learned counsel for the applicant, after arguing for sometime, submits that he does not want to press this application on merit rather he is willing to surrender before the learned court below and file bail application which may be directed to be decided sympathetically. In view of the above, the application is disposed of with liberty to the applicant to surrender before the learned court below and file bail application. In case the applicant surrenders before the learned court below within two weeks' from today and bail application is moved by the applicant, the same shall be decided sympathetically by the learned court below in view of the law laid down by Hon'ble Supreme Court of India in the case of Satender Kumar Antil versus Central Bureau of Investigation and another, Special Leave to Appeal (Cri)No.5191 of 2021.
