After we heard the matter at length, and issue was raised regarding the mode and manner in which the writ petition came to be decided by the learned Writ Court in terms of the judgment impugned in this intra court appeal, despite directing the learned counsel for the respondents therein, in terms of order dated 08.10.2025, to provide a list of all such cases, reference of which was already made by the Division Bench vide order dated 01.03.2021 in LPA No. 31/2021, learned Senior Counsel representing the appellants and the learned counsel representing the respondents reached to a consensus, that the judgment impugned dated 04.11.2025 be set aside and the learned Writ Court be requested to consider the writ petition afresh along with all other matters as referred to in the order dated 01.03.2021 LPA No. 281/2025 passed in LPA No. 31/2021, after affording due opportunity of hearing to all the parties. 2. In view of the consensus arrived at between the parties, judgment impugned dated 04.11.2025 is set aside and the matter is remitted to the learned Writ Court for fresh consideration and disposal in accordance with law. 3. At this stage, Mr. Vikram Sharma, learned Senior Counsel representing the appellants, submitted that interim protection be granted to the appellants. As we have remitted the matter to the learned Writ Court only after a consensus was arrived at between the parties, we are not inclined to show indulgence at this stage, since we have not examined the merits of the case. The appellants may request the learned Writ Court to consider their application for interim relief. 4. Mr. Amit Gupta, learned Senior Counsel appearing for the applicants in CM No. 7870/2025, has submitted that no directions are required to be issued in CM No. 7870/2025, in view of the consensus arrived at between the parties to the intra court appeal. 5. Registry to list WP(C) No. 2790/2025 along with WP(C) No. 1632/2020 and WP(C) No. 15/2021 on 24.12.2025. 6. Disposed of.
