Petitioner has challenged the order dated 06.09.2025, passed by Engineer-in- Chief & Head of the Department, Public Works Department. By the said order, petitioner’s representation for his transfer from Ukhimath, District Rudraprayag to a place in plains, has been rejected only on the ground that in the absence of any reliever, petitioner cannot be transferred out of the Ukhimath. 4. The reason assigned for rejecting petitioner’s transfer appears to be invalid. A reliever would be available only when the transfer order is passed by the Competent Authority, transferring some Junior Engineer at Ukhimath and simultaneously transferring the petitioner out of Ukhimath. It is inaction on the part of the Competent Authority to pass appropriate order of transfer in respect of the petitioner, who has 2025:UHC:9226 already completed 14 years at Ukhimath. 5. The writ petition is, therefore, allowed. Impugned rejection order dated 06.09.2025 is set aside. The case of the petitioner for transfer shall be considered during the next transfer session and some other Junior Engineer shall be posted in place of the petitioner at Ukhimath so that petitioner can be relieved for joining at some other place.
