Petitioner is serving as Assistant Engineer in Public Works Department in Construction Division, Tharali, District Chamolia. According to him, he was transferred to National Highway Division, Public Works Department, Haldwani, vide order dated 11.09.2025, passed by Additional Secretary, Public Works Department. 4. By means of this writ petition, petitioner has sought the following reliefs:- “i. Issue a writ order or direction in the nature of mandamus directing the respondent to relieve the petitioner immediately in pursuance to the order no. 329856/III (1)/2025-55735/TRA/2023, Dehradun, dated 11.09.2025, annexed as Annexure no. 1 to this Writ Petition. ii. Issue a writ order or direction in the nature of mandamus directing the respondent to decide the representation of the petitioner dated 15.09.2025 and 29.09.2025 and relieve the petitioner immediately, annexed as Annexure no. 2 to this Writ Petition.” 5. Learned State Counsel was granted time to get instructions. Today, on instructions, he submits that because of the catastrophe, which hit Tharali on 22.08.2025 and 26.08.2025, the order of transfer passed in respect of the petitioner was cancelled, in order to 2025:UHC:9306 carry out the work of re-construction of roads and other infrastructure. 6. Since petitioner has sought enforcement of transfer order, which has now been cancelled, therefore, no direction can be issued, as has been prayed by the petitioner. 7. Accordingly, the writ petition is dismissed.
