Revenue Civil Sectt. Lko And 4 Others Counsel for Petitioner :- S.K. Singhaniya Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Sri Ram Naresh Singh, Advocate, has filed vakalatnama on behalf of opp. party Nos. 4 and 5, which is taken on record. The petitioners' grievance in this writ petition is against the opp. party Nos. 4 and 5, who are private opp. parties. The petitioners' claim is regarding a piece of land, bearing Gata No. 993va based on some lease. Submission of the learned counsel for the opp. party Nos. 4 and 5 is that there is no actual/physical division of the holding bearing Gata No. 993, though theoretical division has taken place. His clients are also recorded in respect of Gata No. 993, which is a huge tract of land measuring more than 10 Hectares lying in the riverbed. At this stage, the learned Standing Counsel submits that though the land is in riverbed, when the river changed its course, then possession was given to the petitioners. Considering the fact that the land is said to have been leased out to the petitioners and the opp. party Nos. 4 and 5 also claims to have a leased in respect of the the land, therefore, let the S.D.M. get an inquiry conducted into the matter, hear out the petitioners and the opp. party Nos. 4 and 5 and do the needful as per law. Let this exercise be completed within 2 months. With the above observations and directions this petition is disposed of. (Om Prakash Shukla, J.) (Rajan Roy, J.)
