Neutral Citation No. - 2025:AHC-LKO:9514 Court No. - 5 Case :- WRIT - A No. - 1850 of 2025 Petitioner :- Mahesh Prasad Rawat Respondent :- State Of U.P. Thru. Prin. Secy. Agriculture Deptt. Lko. And 4 Others Counsel for Petitioner :- Pradeep Kumar Srivastava Counsel for Respondent :- C.S.C.,Naresh Chandra Mehrotra Hon'ble Abdul Moin,J. Heard learned counsel for the petitioner, learned Standing Counsel and Shri Naresh Chandra Mehrotra, learned counsels for the respondents. The instant writ petition has been filed by the petitioner claiming himself to be the son of Shri Ram Prasad who was an employee of Mandi Parishad and retired in the year 2009 and died in the year 2021. The contention of learned counsel for the petitioner is that the father of the petitioner did not receive the arrears of gratuity and leave encashment of the fifth pay commission and hence the writ petition. Upon specific query being put learned counsel for the petitioner as to how the writ petition would be maintainable at the behest of the petitioner more particularly when he is son of the employee who retired in the year 2009 and died in the year 2021 and never raised any objections for payment of retiral dues meaning thereby that he had been perfectly satisfied with the dues that had been paid to him learned counsel for the respondents is unable to give any reply to the same. Considering the aforesaid, no case for interference is made out. Accordingly, the writ petition is dismissed. Order Date :- 13.2.2025 J. K.
