OMP(M) No. 235 of 2025 The present application has been filed for condonation of delay in filing the present appeal. It has been averred in the application that the copy of impugned judgment and decree dated 03.07.2024 was applied by the counsel on 12.12.2024 and the same was completed on 02.01.2025 and delivered on
08.01.2025. The disposal of the case was not within the knowledge of the applicant, as the same was never intimated to the applicant by its counsel. Further, it has been averred that earlier also due to inefficiency and lackadaisical attitude of the law firm, as many as 362 cases pending in District Mandi/Bilaspur were withdrawn from the said law firm. In the closing of year 2024-25, the applicant inquired the firm about the pendency of the cases and thus, it came to the knowledge of the applicant that objection petitions pertaining to Muhal Kallar have been disposed of. Immediately, the applicant contacted its counsel and the present appeal was prepared and filed without any further delay. It is contended by Ms.Shreya Chauhan, Advocate, that the delay in filing the appeal is neither intentional nor willful, but the same has occurred due to unavoidable circumstances.
Learned counsel for the non-applicant has no objection in case the application is allowed. Consequently, in view of the averments as made in the application, which is duly supported by an affidavit and in view of no objection as imparted by learned counsel for the non- applicant, the present application is allowed and delay in filing the appeal is condoned. Accordingly, the application stands disposed of. Arb. Appeal No._______ of 2026 Appeal be registered. Heard. Admit. Send for records.
OMPST No.28642 of 2025 Subject to deposit of entire awarded amount along with up-to-date interest by the appellant/applicant within a period of eight weeks from today, the operation, implementation and execution of impugned judgment dated 03.07.2024, as passed by learned District Judge, Mandi as well as arbitral award dated 15.02.2023 during the pendency of appeal is ordered to be stayed.
