Considering the law elucidated in the judgments referred hereinafter, the private opposite parties who are the borrowers do not have a right of hearing before us, therefore, issuance of notice to them is dispensed with. Heard. Yet again we have come across a case where an order under Section 14 of the S.A.R.F.A.E.S.I. Act, 2002 has been passed on 12.12.2022, but till date it has not been enforced. We have already delved into the aforesaid issue in detail vide our judgments dated 25.10.2024 and 14.11.2024 rendered in Writ C No. 8867 of 2024 (Bank of Baroda Vs. State of U.P. and 8 others) and Writ C No. 9723 of 2024 (Pnb Housing Finance Ltd. Lko. Thru. Authorised Representative Mr. Surya Prakash Mishra vs. State of U.P. and others), respectively. It is informed that now the date fixed in the matter is 18.02.2025. We hope and trust that whatever has been stated by us in our judgments mentioned above shall be honored in letter and spirit, and a situation shall not be created where we may have to step in and pass some stern orders. The order under Section 14 should be complied positively by the end of this month, unless there is a legal impediment in the form of any stay by higher Court etc. The writ petition is disposed of in the aforesaid terms.
