And 2 Others Counsel for Petitioner :- Suyash Tripathi Counsel for Respondent :- C.S.C. Hon'ble Alok Mathur,J.
1. Heard Mr. Suyash Tripathi, learned counsel for petitioners and learned State Counsel appearing on behalf of opposite parties. 2. With the consent of learned counsel appearing on behalf of the contesting parties, the instant writ petition is being finally decided. 3. Petition has been filed challenging order dated 22.12.2015 so far as it restricts payment of stipend to petitioner during the training period after appointment on direct recruitment of petitioner on the post of Sub-Inspector. Further prayer for payment of arrears of leave salary for the period of aforesaid training in addition to stipend has been sought. 4. Learned Standing Counsel has submitted that the petitioner has approached this Court directly without even approaching the authority concerned with any application for redressal of his grievances and submits that the petitioner should be relegated to his remedy before the appropriate authority. 5. Learned counsel for petitioner also submits that he has not approached the authorities so far but has approached this Court seeking a similar direction which has been passed by this Court with regard to the persons similarly situated. 6. Considering the rival contentions, it is evident that in similar circumstances, this Court had interfered in those cases where representations of the petitioners were rejected by the State which were sent by them. 7. In light of the aforesaid and with the consent of the parties, the writ petition is disposed of with a liberty to the petitioners to move fresh representation before respondent No. 3 i.e. Additional Director General of Police, Karmik / Establishment,
DGP, Headquarters, Police Bhawan, Shaheed Path, Signature Building Gomti Nagar Extension, U.P., Lucknow within two weeks from today and in case such a representation is made, the same shall be considered and decided expeditiously in light of the judgment of the Division Bench of this Court in Special Appeal No. 169 of 2020 (Alok Kumar Singh & Ors. Vs. State of U.P. and Ors) by reasoned and speaking order within a period of six weeks thereafter in accordance with law and communicate the decision to the petitioner.
