DATE : 23.04.2025 P.C. : 1] Heard learned counsel for the applicant and the learned APP for the respondent-State. 2] The applicant is apprehending arrest in connection with Crime No.330/2023, registered with MIDC CIDCO Police Station, Dist. Aurangabad, for the offence punishable under Sections 307, 506 r/w. 34 of the IPC and 135 of Maharashtra Police Act. 3] This Court, by order dated 28.03.2025, has granted interim protection in favour of the applicant for the submissions and reasons stated in para nos.3 to 5, as noted below : 3] The learned counsel for the applicant relies upon the order dated 23.09.2024 passed by this Court in ABA No.28/2024 and submits that co-accused in the present FIR has been granted anticipatory bail. 2025:BHC-AUG:11750 2 419.25ABA 4] The learned APP produced injury certificate which shows that the injuries are simple in nature. 5] Considering that the co-accused has been granted anticipatory bail by order dated 23.09.2024 and considering the observations made in that order, so also, considering that the applicant has not used any weapons in the alleged crime.. 4] The learned counsel for the applicant submits that in terms of the aforesaid order, the applicant has co- operated with the investigation. No further material is found against the applicant. 5] Considering the same, the interim protection granted by order dated 28.03.2025 stands confirmed, in the following terms : i] The applicant shall attend the concerned police station as and when required by the investigating officer. ii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court. 3 419.25ABA 6] In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 7] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 8] The application stands disposed of.
