A case has been registered against the petitioners herein and others for the offences punishable under sections 8(c) r/w 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act,1985 (for short lthe NDPS Act'). 3. The brief facts of the case are thatthis is a case ofillegal transporting of ganja that occurred on 23.01.2025 at about 4.30 a.m. at Venkatachalam Tollplaza, the accused have been in possession and transporting the ganja in vehicle bearing No.AP- 40-EH-7767. On receipt of instructions from AC Enforcement, Nellore, ProhibitI'On & ExcI'Se Inspector, Enforcement Wing, Nellore along with staff conducted raid and seized ganja from the accused. Consequently the above said crime is registered against the accused. 4. Heard. Perused the record. 5. The learned counsel for the petitioners submits that the COntraband alleged to have been seized from the possession of the petitioners/A2, A3, A1, and A4 cannot be considered a commercial quantity. The lea`rned Assistant Public Prosecutor, on the other hand, opposed the bail applications, arguing that all the petitioners are family members and thus proceeded \ ---+-.,--' ` Qr_ \`9 6. To evaluate the submissions made by both sides, I have carefully examI'ned the contents of the medI'atOr'S report, Which indicates that the seizure was made from each indivI'dual. ln lI-ght of this, I find it difficult to accept at this stage that the contraband should be treated as a collective seizure from all the accused Persons/Petitioners. The record shows that the contraband sel'zed from each petitioner l|s less than 20 kg, which cannot be construed as a commercI'al quantity. when ascertained the learned Assistant publI-C Prosecutor confirmed that the Petitioners have nO Previous antecedents under the NDPS Act. lt seems that the petitioners/Al to A3 are resI-dent of Chennai and petitI'Oner/A4 Its resident of Guntur DistrI~Ct.
