Mr. Akshay Pradhan, Advocate, for the petitioner. Mr. Pankaj Chaturvedi, Central Govt. Standing Counsel, for the respondents. (2) Petitioner applied for re-issue of passport on 13.11.2024. Since no decision was taken on his application, therefore, petitioner approached this Court seeking the following reliefs “I. Issue a writ, order, or direction in the nature of Mandamus directing Respondent No. 2 to forthwith process and re-issue the passport of the Petitioner pertaining to File No. DD1070500989024, within a time-bound period as may be fixed by this Hon’ble Court; II. Issue a writ, order, or direction declaring that the inaction on the part of Respondent No. 2 is arbitrary, unreasonable, and violative of Articles 14 and 21 of the Constitution of India;” (3) Mr. Pankaj Chaturvedi, appearing for Regional Passport Officer, was granted time to get instructions. Today, on instructions, he submits that a criminal case under Section 420 IPC was pending against the petitioner in the Court of Additional Chief Judicial Magistrate, Saharanpur, due to which adverse report was received from the local police. (4) Learned Counsel for the petitioner submits that learned Trial Court has acquitted the petitioner of the charge 2025:UHC:9253 of offence punishable under Section 420 IPC and no appeal has been filed against acquittal of the petitioner, therefore there is nothing adverse against the petitioner. (5) Mr. Pankaj Chaturvedi submits that if petitioner makes an application for re-issue of passport, the same shall be considered and processed, as per law. (6) Accordingly, writ petition is disposed of with liberty to petitioner to make a fresh application for re-issue of passport. If petitioner makes such application within ten days from today, Regional Passport Officer shall take decision on petitioner’s application within four weeks thereafter.
