A case has been registered against the petitioner and another for the LI offence punishable under Section 20(b)(ii)(B) r/w 8(c) of NDPS Act. 3. Heard learned counsel for the petitioner/A.1 and the learned Assistant Public Prosecutor representing the respondent/State. a \.` .` -'-\ 4. Case of the prosecution, in brief, 'ls that, on 25.02.2025 at about 4.00 p,m., on receipt of credible information regarding illegal possession and transportation of ganja, the S.I. of Police, Palasa RP Station, along with staff and mediators rushed to booking counter of Palasa Railway Station and found one person in suspicious circumstances. On enquiry, the said person disclosed his identity as that of A.1 and police found 5 Kgs. of ganja in his possession. Immediately, police seized the contraband and arrested the accused and got him remanded to judicial custody on the same day. 5. Heard. Perused the record. 6. Learned counsel for the petitioner/A.1 contends that the contraband said to be involved in this case is 5 Kgs. of ganja, which is non-commercial quantity and the petitioner is in judicial custody from 25.02.2025. He further submits that the petitioner is a permanent resident of Antaraba Village of Orissa State and prays to enlarge the petitioner on bail. 7. Learned Assistant Public Prosecutor opposed to grant bail on the ground that investigation is not yet completed. I Tf--Jrrfu ~=-``3 8, After careful observation of the material on record and SubmiSSiOnS made on behalf of both sides, it shows that the petitioner was arrested and remanded to judicial custody on 25.02.2025 and the seized contraband iS Only 5 Kgs, of ganja, which is non-commercial quantity. Since the Petitioner has been in remand from 25.02.2025, this Court found that most Of the investigation pertaining to the role played by the petitioner in the commission of the offence would be completed. lt is submitted that the petitioner has permanent abode and there is no possibility of their fleeing away from justice and most of the witnesses are official witnesses and the release of the petitioner would not cause tampering of evidence and hampering of investigation. when ascertained, the learned Assistant Public Prosecutor submitted that no antecedents are reported against the petitioner. considering the entire m^ater'lal on record, this court is inclined to grant bail tO the petitioner/A.1 with some conditions. 9, In the result, the Criminal Petition is allowed With the following conditions: (i) The petitioner/Al herein shall be released On his executing a personal bond for Rs.10,000/-(Rupees Ten thousand Only) With one surety for a like sum to the satisfaction of the learned Judicial Magistrate of First Class for Railways, VisakhaPatnam; (ii) on release, -the petitioner shall appear before the Station House Officer concerned Once in a month i.e. On every 2nd sunday between 10.00 a.m. and 05.00 p.m., ti" filing of the charge sheet; and it>-.r- I ` ` .
