Mr. Bhaskar Chandra Joshi, learned A.G.A. for State of Uttarakhand/respondent Nos.1 & 2. 3. Learned counsel appearing for petitioner made a statement at Bar that he has got no instruction in respect of present writ petition, as the file has been taken away by the petitioner. 4. However, learned State Counsel on instruction submits that after investigation, charge-sheet has been submitted against the petitioner and two other persons on 30.11.2022. The said instruction passed on to this Court by learned State Counsel, which is taken on record. 5. In view of the statement made by learned State Counsel, nothing remains to be decided in the present criminal writ petition and it has rendered infructuous. 6. Accordingly, the present criminal writ petition is dismissed as infructuous. However, it is open to petitioner to challenge the charge-sheet before the appropriate forum in appropriate proceedings, if so advised. 7. Interim order dated 27.12.2021 stands vacated.
