Neutral Citation No. - 2025:AHC-LKO:10611 Court No. - 15 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 221 of 2025 Applicant :- Rajesh Kumar And Another Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. And Another Counsel for Applicant :- Sonal Chaurasia Counsel for Opposite Party :- G.A. Hon'ble Shree Prakash Singh,J. Heard learned counsel for the applicants, learned AGA for the State and perused the record. The instant anticipatory bail application has been filed on behalf of the applicants with the prayer to release them on anticipatory bail in Case Crime No.94 of 2023, under Sections 308, 323, 504, 506 I.P.C., Police Station Kotwali Bikapur, District Ayodhya. From the perusal of the F.I.R. as well as other documents appended therewith, it transpires that the applicants are named in the F.I.R. and the injured have also named the applicant. From the injury report, it is apparent that injury is on the frontal region of head and that is lacerted wound. Thus, the allegations are serious in nature. Learned counsel for the applicants has failed to satisfactorily substantiate that the applicants would not tamper the evidences and would not threaten the witnesses. Apprehension of arrest has also been denied. Considering the complicity of the accused and the gravity of offence, this Court do not find any good ground to intervene in this matter. Consequently, the instant anticipatory bail application is hereby dismissed. Consigned to records. However, it is open to the applicants that they may approach the trial court while claiming benefit of Satender Kumar Antil versus Central Bureau of Investigation and another (2022)10 SCC 51.
