JUSTICE SUSMITA PHUKAN KHAUND ORDER Date : 22-05-2025 Heard learned counsel Ms. Otoli Kits for the petitioner Inavi Zhimo, who has filed this application under Section 483 of Bharatiya Nagarik Suraksha Sanhtia, 2023 with prayer for bail as he is behind bars since 05.05.2025 in connection with Khatkhati Police Station Case No. 45/2025 (GR No. 102/2025)
Page No.# 2/3 under Section 61(2)/123 of Bharatiya Nyaya Sanhita, 2023 read with Section 21(1) of Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Heard Mr. M.P. Goswami, learned Additional Public Prosecutor, Assam, who has raised serious objection stating that the petitioner is involved in transporting drugs. It is submitted that investigation is still in its nascent stage and the person from whom the petitioner has procured the drugs is yet to be identified and arrested. Moreover, it is submitted that the petitioner is not a local resident and he is a flight risk. 3. It is submitted on behalf of the petitioner that his brother has to undergo dialysis. Moreover, the petitioner’s mother is an elderly ailing person. Annexure- 2 of the petition, are the medical documents. 4. I have considered the submissions at the bar with circumspection. I have considered the plight of the petitioner. The petitioner is willing to cooperate with the remaining part of investigation. 5. Considering all aspects, the petitioner is enlarged on bail on furnishing a bail bond of Rs.50,000/- (Rupees Fifty Thousand) with two local sureties of like amount to the satisfaction of the learned jurisdictional Court/Eleka Magistrate under the conditions that :- (i) the petitioner shall refrain from such activities with which he is alleged, (ii) the petitioner shall cooperate with the remaining part of investigation, (iii) the petitioner shall not jump the bail and,
Page No.# 3/3 (iv) the petitioner shall appear before the Investigating Officer on every fortnight till completion of investigation. 6.
6. On breach of any of the bail conditions, the Court is at liberty to cancel the bail granted to the petitioner. 7. In terms of the above observation, this Bail Application stands disposed of. JUDGE Comparing Assistant
