The learned counsel for the petitioner submits that the petitioner is aggrieved by the order of the Family Court – VI Additional District Judge, Nellore, whereby, the learned Judge directed the police to execute the non-bailable warrant issued against the petitioner. 2. The learned counsel for the petitioner further submits that the petitioner is due an amount of Rs.5,20,000/- and that after filing the Criminal Revision Case (Crl.R.C.) before this Court, the petitioner has been regularly paying maintenance. 3. Without delving into the details of the arrears due payable to the 2nd respondent, there shall be a stay on the operation of the order passed by the Family Court – the learned VI Additional District Judge, Nellore, directing the execution of non-bailable warrants against the petitioner for a period of eight (08) weeks. 4. In the meanwhile, the petitioner shall deposit an amount of Rs.3,00,000/- in the name of the 2nd respondent by way of a Demand Draft (DD). Upon such deposit, the learned Judge shall hand over the Demand Draft to the 2nd respondent, duly obtaining acknowledgment from the 2nd respondent. The petitioner is also HN, J CRL.P.No.3093_2025 3 required to file an application under Section 72(2) of the BNSS, and the learned Judge shall recall the warrant on the terms and conditions specified, along with any additional terms necessary for compliance with the order passed in M.C.No.77 of 2018. 5. Accordingly, the Criminal Petition is disposed off.
