ORDER:
1. The Writ Petition is filed questioning the action of the respondents in proposing to demolish the house structures of the petitioner in an extent of 96.61 sq. yards in Sy.No.162 of Tirupati Urban Mandal, Tirupati District, house bearing assessment No.1012073125, Door No.22-9-19/E, Padmavathi Nagar, Tirupati, pursuant to possessory agreement of sale, without following due process of law, as illegal, arbitrary.

Learned counsel for the petitioner submits that the vendor of the petitioner one Mr.J. Narayana was said to have allotted house site patta by the Mandal Revenue Officer, Tirupati. Thereafter, the petitioner is said to have entered into agreement of sale on 27.03.2012 and since then, she is in possession of the said property. While so, without issuing any notice to the petitioner, Respondent- Corporation is attempting to demolish.
3. Learned Standing Counsel for the Respondent-Corporation, on instructions, submits that the petitioner had illegally occupied Government lands in an extent of 96.61 sq. yards without valid title. Though the same was classified as ‘Kaluva Poramboku’ (water channel) within Tirupati Village. It was also stated that the petitioner did not obtain permission for construction of residential building and that the construction is made of asbestos sheets. Since the occupation and construction of the petitioner is illegal, the action against the petitioner has been contemplated.

In view of the submission of the learned Standing Counsel, the Writ Petition is disposed of, leaving it open to the petitioner to put the petitioner on notice, call for explanation and then, take further action regarding the constructions made by the petitioner. Till such time, no coercive action shall be taken against the petitioner.
