No one appears for the opposite parties. In terms of the office report, the service on the opposite party is complete. Need sufficient on the counsel for the petitioner is that on account of a claim raised by the respondents, the same was settled and the amounts was duly deposited vide order dated 19.02.2021 before the Consumer Forum, Lucknow in complaint Case No.48 of 2019. However despite the said settlement, the permanent Lok Adalat has passed an award arising out of the same claim which is impugned in the present writ petition. As no one has put in appearance on behalf of opposite party Nos. 1 & 2 and from records it is clear that the amount of Rs.5,00,000/- was duly deposited by the petitioner company in terms of the settlement, no fresh award could have been passed arising out of the same claim as such the award dated 18.11.2021, impugned in the writ petition cannot be sustained and is quashed, the amount deposited by the petitioner in Consumer Case No.48/2019 shall be paid to the respondents if not already paid.
