PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Petition, u/See.480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/accused, seeking regular bail, in Crime No.14/2025 of Kanaganapalli Police Station, Sri Satya Sai District. 2. A case has been registered against the petitioner for the offence punishable u/See.109(1 ) r/w 3(5) of the B.N.S. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondent/state. EZil +i ------J\ I - _ _ 2 4. The brief facts of the Prosecution case are as follows: This is a case of Attempt to Murder that occurred on 09-02-2025 at around ll.30 am in front of Ramana's welding shop in Thogarakunta village of Kanaganapalli Mandal and reported in the P.S. on O9-02-2025 at 09 pm wherein the accused No.1-Chakali Narasimhulu, and Accused No.2-Anand Reddy had allegedly formed into a group with common intension to kill Vadla Chennappa, Narasimlulu allegedly armed wI'th an iron rod and attacked Chennappa on left side of his head and caused severe blood inJ'ury while, Anand Reddy attacked Chennappa with iron rod on his right leg and caused blood injury. In order to rescue himself, the said Chennappa, threw a sickle on Narasimhul which was caused blood injury to his right leg. The incident has been taken place Kaluding Jayaramu, Sreeramu and others who accompanied the spot intervened the issue and among the groups followed by the earlier political ill feelings. Observing the incident, the locals rescued Chennappa from the accused clutches while rushed him to Hitha Hospital, Ananthapuramu where he was rendered medical aide by the duty doctor. Basing on the written report of vadla chennappa, the s.I. of police, Kanaganapalli PS has registered a case and investigated into. 5. Heard. Perused the record. 6. Learned counsel forthe petitionersubmits thatthe petitionerhas been in judicial custody from ll.02.2025 and most of the investigation might have been completed and the statutory period of 60 days was completed and prays to enlarge the petitioner on bail. €/ 3 7. Learned Public Prose¥'cutor submits that wound certificate is not yet received and there are some more witnesses to be examined. He further submits that the petitioner has no antecedents and the court may pass appropriate orders. 8. After careful observation of the material on record and submissions made on behalf of both sides, it shows that the petitioner has been in J'udiCial a` \ custody from ll.02.2025 and investigation is not completed. When ascertained, learned PublI'C Prosecutor submits that the injured in this case said-to be discharged from the hospital. considering the remand period of the petitI'Oner i.e., On ll.02.2025, this Court is of the view that by this time most of the investigation might have been completed with regard to the role played by the petitioner. This Court feels that release of the accused would not cause tampering of evidence and hampering of investigations and the Petitioner has got Permanent abode at Gunthapalli Village, Kanaganapalli Mandal, Sri Satya Sai District, as such there is no possibility of his fleeing away from justice. ln the said facts of the case, this court is inclined to grant bail to the petitioner. 9. ln the result, the criminal petI'tiOn iS allowed With the following conditions: (i) The petitioner/accused herein shall be released on his executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the learned Judge Family Court-Gum-Vll Additional District and Sessions Judge, Ananthapuram District; {35ffZE71jiE@ E= I ` I 4 (ii) on release, the petitioner shall appear before the station House Officer concerned on every Sunday between 10.00 a.m. and o1.00 p.m., for a period of three (03) months.
