The present petition has been filed with the following prayers : "(i) Issue a writ, order or direction in the nature of MANDAMUS thereby commanding the opp. Parties specially the opp. Party No. 2 to 4 to remove the illegal encroachment of the Opp. Party No. 6 from the land gata No. 256/0.4700 hec.. which is recorded as pond in the revenue record situated at village Parewakhan pargana Tahsil and District Bahraich with immediate effect. (ii.) Issue a writ, order or direction in the nature of MANDAMUS thereby commanding the Opp. party No. 2 to 4 to remove the illegal encroachment of the encroachers from the land gata No. 348, 15, 211 & 150 which is recorded as Khalihan and land gata No. 218 & 258 which is recorded as Khad Gaddha, and from the land gata No. 66, 157, 48, 65, 84, 313, 73, 154, 258, 77, 82, 324, 152, 253, 32, 67, 378, 68, 314 & 145 which is recorded as Navin Parti in the revenue record. " 3. The Standing Counsel, based upon the instructions, states that a team has been constituted for identifying the land and the nature of the land, which is alleged to be encroached and thereafter action shall be taken for removal against the encroachers. 4. In view of the said statement, the present petition is disposed off expecting the State Government to take action in accordance with law with all expedition preferably within a period of four months. 5. In case no action is taken, the petitioner would be at liberty to approach this court again.
