Learned counsel for the applicant has submitted that a case under Section 498 A, 323, 504, 506 IPC and under Section 3/4 of Dowry Prohibition Act (State Vs. Amit Kumar Trivedi and others) is pending before the trial court. It is further submitted that cognizance was taken for the first time on 16.01.2020 and the case is at the stage of evidence which is being avoided by the respondent no. 2 and the Court has already issued a non bailable warrant against the respondent no. 2 by its order dated 30.11.2024. It is further submitted that the applicant is being harassed as she appeared on each and every date except few but due to the non appearance of the respondent no. 2, the case could not be decided. After arguing at some length, learned counsel for the applicant has confined his prayer to the extent that a direction may be issued to the Court concerned to decide the case within the time fixed by this Court. After hearing learned counsel for the parties and going through
the order sheet enclosed with the present case, it is found that the trial court is passing appropriate orders at appropriate stage for securing the presence of respondent no. 2 i.e. the Court has already issued non bailable warrant against the respondent no. 2 but looking into the plight of the applicant being a lady and facing harassment, it is expected that the learned trial court may decide the case expeditiously in accordance with law after giving opportunity of hearing to the parties concerned and without providing any unnecessary adjournment to either of the parties.
