2. Petitioner is running a fair price shop in District Haridwar. His licence to run fair price shop has been suspended by District Magistrate, Haridwar vide
order dated
26.09.2025. Petitioner has challenged the suspension order in this writ petition.

Learned counsel for the petitioner submits that the allegation made against petitioner that he has not distributed sugar to the persons living below the poverty line, is incorrect. As petitioner has not lifted any sugar since January, 2025, therefore, there can’t be any allegation levelled against him that he has black marketed the sugar.
4. He further submits that as many as 16 persons have given affidavits in support of petitioner that he is distributing food grains strictly, as per law.
5. Learned State Counsel, per contra, refers to suspension order (from page 25 of the writ petition), where the statement given by residents of the village have been recorded. Based on those statements, learned State Counsel submits that petitioner is habitually committing irregularity in distribution of food grains, therefore, on the complaint made by
2025:UHC:9153 villagers, order of suspension has been passed.
6. He submits that an inquiry will be held in the matter and after inquiry, final order shall be passed. He thus submits that suspension is a temporary arrangement which shall continue till passing of the final order upon conclusion of the inquiry.
7. Learned State Counsel further submits that suspension order is appellable before Commissioner as per clause (14) of Government Order dated 15.10.2005, issued by Secretary, Department of Food, Civil Supplies and Consumer Affairs.

Learned counsel for the petitioner do not dispute the said contention.
9. In such view of the matter, writ petition is
disposed of with liberty to petitioner to file Appeal before the Commissioner, Garhwal Mandal against impugned suspension order.
10. If he files appeal within one week from today, Commissioner, Garhwal Division shall make endeavour to decide the appeal within three months thereafter.
11. Pending application (s), if any, also stand
disposed of.
