Counsel for the Respondent/complainants: Ld. Public Prosecutor The Court made the following order:
1. Heard the learned Senior Counsel appearing for the petitioner.
2. The learned Senior Counsel appearing for the petitioner virtually online submits that the petitioner is alleged to have committed an offence under Section 420 of the Indian Penal Code, 1860. It is further submitted that the 2nd respondent has filed a complaint alleging that the petitioner cheated
-2- CRL.P. No.3125 OF 2025 her under the pretext of marriage. It is also submitted that the 2nd respondent became acquainted with the petitioner in the year 2011 while she was employed as a staff nurse at the Government Maternity Hospital, Tirupati. During this time, the petitioner and the 2nd respondent allegedly lived together. It is further alleged in the complaint that petitioner had cheated the 2nd respondent with a promise to marry and that he has subsequently married someone else. It is also submitted that the petitioner is presently working in the United Kingdom and is scheduled to leave the country on 02.04.2025.
3. Considering the submissions, this Court is inclined to dispose off the criminal petition by directing the Station House Officer, Tirupati West Police Station, Tirupati, to issue notice to the petitioner under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, and record the statement of the petitioner as expeditiously as possible for the purpose of investigation in connection with Crime No.164 of 2024.
4. Accordingly, the criminal petition is disposed off.
5. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed. ___________________ JUSTICE HARINATH.N BV
