Heard the learned senior counsel for the applicant, namely, Mr. N. Ibotombi and also heard the arguments advanced by the learned counsel for the respondents, namely, Mr. K. Roshan who are present before this court physically. This miscellaneous application has been filed by the applicant praying for deleting the name of the applicant from CONT. CAS (C) No. 49 of 2025 who is arrayed in the rank of respondent No. 4. Whereas the learned counsel for the respondents submits that the application filed by the applicant may be considered as the applicant was not arrayed in the rank of party in the original proceeding as in the writ petition or in the writ appeal. Keeping in view the submission made by the learned senior counsel for the applicant as well as the learned counsel for the respondents, it is deemed appropriate that this proceeding in MC [CONT. CAS (C)] No. 62 of 2025 be allowed in the interest of justice and consequently, ordered for deleting the name of the applicant herein/respondent 4 as a party in the aforesaid proceeding in CONT. CAS (C) No. 49 of 2025. Consequently, MC [CONT. CAS (C)] No. 62 of 2025 is hereby allowed.
