Neutral Citation No. - 2025:AHC-LKO:9315-DB Court No. - 2 Case :- WRIT - C No. - 1437 of 2025 Petitioner :- Ravi Nath Singh Respondent :- State Of U.P. Thru. Addl. Prin. Secy. Energy U.P. Lko. And 3 Others Counsel for Petitioner :- Diwakar Prasad Sharma,Neetu Patel Counsel for Respondent :- C.S.C.,Manish Jauhari Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard learned counsel for the petitioner as also Sri Manish Jauhari, learned counsel for the Electricity Corporation, the learned Addl. C.S.C. for the State and perused the record. Recovery-certificate was issued based on the provisional assessment. Subsequently objections were received and final assessment was made, which was less than the amount mentioned in the provisional assessment, therefore, the impugned recovery-certificate, as stated by Sri Manish Jauhari, Advocate, appearing for the Electricity Corporation, would be withdrawn. We see no reason as to why we should postpone the matter for withdrawal of the impugned recovery-certificate. In view of what has been stated, we quash the impugned recovery-certificate, with liberty to the opp. parties to proceed afresh, but as per the final assessment. With these observations, the instant writ petition is disposed of. (Om Prakash Shukla, J.) (Rajan Roy, J.)
