Heard learned counsel forthe petitioners/A.1, A.2 &A4 and the learned Assistant Public Prosecutor representing the respondenvstate. 4. Case of the prosecution, in brief, is that, on o2.03.2025 at4.OO p.m., on receipt of credible information regardl'ng illegal possessI'On and transportation of ganja, the S.I. of Police, Gopalapatnam Police Station along with staff and mediators rushed to the backside of Aditya college near Burial ground, Gopalapuram and found four persons and on seeing the police, they tried to escape. The police caught them and on enquiry, the saidtpersons disclosed their identity as that of A.1 to A,4 and they confessed that they purchased 1 Packet of ganJ®a Weighing 1 kg 750 grams from A.5. Immediately, police seized the contraband and arrested the accused and g6t them remanded to judicial custody on the same day. cffi±:a=- &c iji; Ei-lJP 7. Learned Assistant Public Prosecutor opposed tO grant bail On the ground that investigation is not yet completed. \e--fuQ~. ce==-L__-_3 8. After careful observation of the material On record and SubmiSSiOnS made on behalf of both sides, it shows that the petitioners were arrested and remanded to judicial custody on o2.03.2025 and the seized contraband iS Only 1.750 Kgs. of ganja, vihiCh iS nOn-commercial quantity. Since the petitioners have been in remand from o2.03.2025, this Court is of the op'In'IOn that most Of the investigation pertaining to the role played by the petitioners 'ln the commission of the offence would be completed. lt is submitted that the petitioners are aged 18 years only and they are living their livelihood by attending agricultural labour work. when ascertained, the learned Assistant public prosecutor submitted that no antecedents are reported against the petitioners. As the most Of the W®ltneSSeS are Official Witnesses, the release Of the petitioners would not cause tampering of evidence and hampering of investigation. considering the entire material on record, this Court is inclined to grant bail to the petitioners/A.1, A.2 & A.4 with some conditions. I 9. ln the result, the- Criminal Petition is allowed with the following r| conditions: (i) The petitioners/A1, A,2 & A.4 shall be released on their executing a personal bond for Rs.10,000/- (Rupees Ten thousand only) each with one surety for a like sum to the satisfaction of the learned III Additional Chief Judicial Magistrate, ( Visakhapatnam ; (ii) On release, the petitioners shall appear before the Station House Officer concerned once in a month i.e. on every 2nd Sunday between 10.00 a.m. and 05.00 p.m., for a period of three (3) months; and (iii) the petitioners shall not tamper with the evidence and hamper the investigation and shall cooperate for investigation.
