The present application has been filed against the impugned summoning/cognizance order dated 21.12.2024 and the order dated 30.1.2025 passed by learned Additional District and Session Judge/FTC Court No.1 Gonda arising out of Complaint Case No.126 of 2024 under section 18(Ga)/27 (kkha(ii), 18Ka/28 The Drugs and Cosmetics Act, 1940, Police Station Kaudiya, District Gonda pending in the court of learned Additional District and Session Judge/FTC Court No.1 Gonda as well as for quashing of the proceedings of the entire complaint. After arguing for some time, learned counsel for the applicant submits that the applicant may be permitted to move an application for discharge through counsel and the same may be decided by the trial court in a time bound manner. In view of the above, the application is disposed of permitting the applicant to move an appropriate application for discharge through counsel before the concerned court below within a period of fifteen days' from today. If the application is filed, the same shall be considered by the concerned Court below expeditiously and preferably within a period of one month thereafter. In case no such application is filed within a period of fifteen days from today, as prescribed above, the benefit of present order shall not be available to the applicant.
