The present petition has been filed by the petitioner stating that against an ex parte decree, an application under Order IX, Rule 13 of the CPC has been filed, in which a stay application has also been filed. However, without deciding the same, the decree is likely to be executed. 3. Considering the fact that the petitioner has filed an application for grant of interim relief in the application under Order IX, Rule 13 of the CPC, the present petition is disposed of directing the trial court to decide the interim application filed by the petitioner in the application under Order IX, Rule 13 of the CPC within a period of two weeks.
