AMARNATH GOUD O R D E R 01.09.2025 [1] Heard learned counsel appearing for the respective parties. [2] This present writ petition is filed under Article 226 of the Constitution of India seeking the following reliefs: “i) Issue notice upon the Respondents. ii) Call for the Records. iii) Issue Rule calling upon the Respondents to show cause as to why the Petitioner shall not be given the benefit of one increment as per Rule 13(1) (ii) of the Tripura States Civil Services (Revised Pay) Rules, 2009. AND Issue Rule calling upon the Respondents to show cause as to why the increment under Rule 13 (1) (ii) of Rules of 2009 shall not be counted in the present service of the Petitioner and further be pleased to issue direction to refix the pay of the Petitioner and grant arrears accordingly. AND Issue Rule calling upon the Respondents to show cause as to why the memorandum dated 6th July, 2011 issued by the Finance Department, Government of Tripura shall not be set aside and quashed. iv) And after hearing the parties, be pleased to make the rule absolute. AND/OR Pass any other order/orders as deemed fit and proper by this Hon'ble Court.” [3] It is seen from the record that a forwarding letter dated 06.02.2024 has been issued by the Assistant Head Master, Head of Office & DDO, Chlakaham H/S School , Karbook, Gomati Tripura addressed to the Director, Secondary Education Department, Govt. of Tripura, enclosing the letter of the petitioner herein i.e., Anil Chandra Das seeking for payment of advance increment for his B.Ed degree but the same is pending with the concerned respondent. [4] In view of the above, without expressing any opinion on merits of the case, this present writ petition is disposed of directing the concerned respondent(s) to decide the letter dated 06.02.2024 within a period of two months from the date of receipt of the copy of this order in accordance with law and communicate the decision to the petitioner. [5] With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed. DR.
