[2025:JHHC:14980 ] IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 3916 of 2025 1. Ramu Turi @ Ramu Kumar Turi , aged about 41 years, son of Baldeo Turi, 2. Deepak Turi @ Deepak Kumar Turi, aged about 31 years, son of Baldeo Turi, Both are the residents of village Bhandaridih, P.O - Giridih, P.S - Giridih (M), District - Giridih … Petitioners Versus The State of Jharkhand … opp. party Coram: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY For the Petitioners : Mr. Ram Lakhan Yadav , Adv. For the State : Mr. Jitendra Pandey , Addl.PP. 02 / 10.06.2025 Heard the parties. The petitioners have been made accused in connection with Deori P. S. case no. 12 of 2023 instituted under Sections 302, 34 of IPC. Learned counsel appearing for the petitioners submits that the allegation against the petitioners is that the petitioners in furtherance of common intention with the co-accused persons, committed murder of Raj Kumar Turi. It is submitted that the allegation against the petitioners is false and the deceased died after ten days of the occurrence and there is no allegation against the petitioner of using any weapon. It is next submitted that the petitioners have been in jail custody since 09.01.2025, as mentioned in para 8 of this bail application. It is next submitted by learned counsel for the petitioner that the petitioners are ready and willing to co-operate with the trial of the case hence, the petitioners may be admitted to regular bail. Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that the petitioners have been absconding for two years after the day of occurrence hence, there is every chance of the petitioners absconding again, if released on bail and also there is chance of the petitioners tampering with the evidence. It is further submitted that the post mortem report goes to show that the deceased died because of the head injuries inflicted by the petitioners and the head injuries were inflicted upon the victim by the assault, made by the petitioners. It is therefore submitted that the petitioners ought not be released on bail at this stage. Considering the serious nature of allegation against the petitioners and as there is every chance of the petitioners absconding, if released on bail and also the chance of the petitioners tampering with the evidence, this Court is of the considered view that this is not a fit case where the above-named petitioner be released on bail. Accordingly, the prayer for bail of the above-named petitioners is rejected. (ANIL KUMAR CHOUDHARY, J.) Smita/-
