With the consent of learned counsel for the contesting parties, the instant writ petition is being finally decided. Contention of learned counsel for the petitioner is that her husband namely Sri Nitish Rastogi who was working as Assistant Teacher died in harness on 12.09.2020. The petitioner has staked her claim for compassionate appointment in terms of the relevant rules yet her consideration has still not been done till date. Considering the aforesaid, the writ petition is disposed of leaving it open to the petitioner to submit a fresh application for being appointed on compassionate ground. In case, such an application is preferred a week from today then the competent authority who is said to be the Basic Shiksha Adhikari, Hardoi shall consider the said application in accordance with law and the relevant rules. Let such a consideration be made within a period of six weeks from the date of receipt of the said application along with the certified copy of this order. Disposed of. It is made clear that this Court has not gone into the merits of the claim as set forth by the petitioner.
