It has been clarified that the Review has been filed in CWPOA No.7615 of 2025 and not in CWPOA No.4000 of 2020, as mentioned in the order dated 02.06.2025.

Since a Review has also been preferred, which is stated to have been filed alongwith an application for condonation of delay, after the filing of the present LPA against the same judgment, we are

2 of the view that two remedies are not available to the State as such.

Faced with this situation, counsel for the State does not press the present LPA and reserves her right as such to challenge the order passed in the Review petition, in case it is adverse and alongwith the main order dated 16.09.2023.

Accordingly, the Appeal is disposed off as not pressed, with the aforesaid liberty.

The interim order passed in favour of the State shall continue for a period of four weeks only. It will be open to the learned Single Judge to pass appropriate orders in case the said Court so desires.

Pending applications, if any, also stand disposed of accordingly.
