Petitioner participated in a selection for the post of Assistant Statistical Officer held by Uttarakhand Public Service Commission. Due to his less score of marks, petitioner’s name was not included in the select list and his name has not been recommended for appointment to the competent authority. In this writ petition, petitioner has raised the issue of qualification of certain candidates who have been so recommended. 3. Learned counsel for the petitioner submits that since those selected persons also possessed the same qualification as is possessed by the petitioner, therefore, petitioner should have been included in the merit list. 4. Mr. Ashish Joshi, learned counsel appearing for the selecting body, however, submits that petitioner’s candidature was not rejected on the ground that the qualification 2025:UHC:9216 possessed by him is not as per the rules, but his name was not included in the select list because of his less score of marks, thus the writ petition is wholly misconceived and there is no scope for interference by this Court. 5. This Court finds substance in the submission made by Mr. Ashish Joshi, learned counsel. 6. Petitioner remained unsuccessful because of less score of marks and not because of any infirmity in his qualification. 7. Thus there is no scope for interference in the matter. The writ petition fails and is dismissed. 8. Pending application (s), if any, stand disposed of.
