01.08.2018. It is submitted by learned counsel appearing on behalf of the applicants that no further proceedings against the said decision is pending before the Hon’ble Apex Court. No reply is intended to be filed on behalf of the non- applicants. The sole appellant, in the case at hand is stated to have expired on 05.05.2020. The same is evident from the Death Certificate (Annexure A-1) appended along with present application. From perusal of the Legal Heir Certificate (Annexure A-2) appended along with present application, it is evident that the deceased sole appellant is survived by his legal heirs detailed therein. One of the legal heirs, i.e., Peer Chand, son of sole deceased appellant-Likhit Ram is also stated to have expired on
15.11.2021. The same is evident from the Death Certificate (Annexure A-3) appended along with present application. Since the right to receive compensation, in the case at hand, has accrued upon the legal heirs of the aforesaid deceased appellant, therefore, the present application is allowed. The legal
heris of sole deceased appellant and his deceased legal heir, namely Peer Chand, are ordered to be brought on record. The application stands disposed of. Amended memo of parties filed with the application is taken on record. CMP No.24896 of 2024
The appeal (RFA), in the case at hand, was decided on
01.08.2018. It is submitted by learned counsel appearing on behalf of the applicants that no further proceedings against the said decision is pending before the Hon’ble Apex Court. No reply is intended to be filed on behalf of the non- applicants. The non-applicants have no objection, if in case, the amount deposited in the Registry of this Court along with up-to- date interest accrued thereupon, is ordered to be released in favour of the applicants. In view of aforesaid and for the reasons stated in the application, the same is allowed.
The amount lying deposited in the Registry of this Court along with proportionate interest accrued thereupon, is ordered to be released in favour of the applicants, as per their share, by remitting the same in their bank accounts, details whereof, have been furnished in Paragraphs-4 and 7 of the application, subject to proper verification.
