Neutral Citation No. - 2025:AHC-LKO:8868 Court No. - 16 Case :- CRIMINAL REVISION No. - 166 of 2025 Revisionist :- Shani And 5 Others Opposite Party :- State Of U.P. Thru. Prin. Secy. Lko. And Another Counsel for Revisionist :- Ankit Kumar Trivedi,Durgesh Kumar Singh Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. Vakalatnama filed by Mr. Sanjay Kumar Singh, Advocate on behalf of opposite party No. 2 is taken on record. This Criminal Revision has been filed by the revisionists against the order dated 10.01.2025 passed by the court of Additional District and Session Judge, Court No.3, Ayodhya/Faizabad in Sessions Trial No. 281/2023: State Vs. Shani and others, under Sections 147, 148, 323, 326, 307 and 352 I.P.C., whereby the revisionists have been summoned. Heard Sri Atul Tiwari, Advocate holding brief of Sri Ankit Kumar Trivedi, learned counsel for the revisionists as well as Sri Sanjay Kumar Singh, learned counsel for the opposite party No.2 and Sri Ashok Kumar Srivastava, learned A.G.A. for the State.
Learned counsel for the revisionists submits that while passing the impugned order injury of one Meghraj has been considered. There is no injured Meghraj in the prosecution case. In compliance of the order dated 10.02.2025, learned A.G.A. has produced Case Dairy before this Court. A perusal of the impugned summoning order as well as the Case Diary, it is apparent that there are two injured in this case. One is Ram Prasad-informant and another is Ramtej. Both are injured. I have seen the injury report in the Case Diary, which has been produced by learned A.G.A. A perusal of the injury report, statements of the injured and prosecution witnesses, prima facie, show commission of offence under Section 326 and 307 I.P.C., although in the impugned order, injury of Ramtej has been referred by the learned court below, however in the last paragraph, it appears that due to typographical error, in place of Ramtej, name of Meghraj has been inserted which is nothing but an
typographical error and which will not vitiate the proceedings. There appears no illegality in the impugned order. The revision is devoid of merits and is accordingly dismissed.
