The petitioner is claiming compensation for Gata no.64 situated in Village- Saraiya Mahuli (East), Tehsil- Dhanghata, District- Sant Kabir Nagar and has also prayed for a direction to respondent no.2 to decide his representation dated 29.11.2024. 2. The case of the petitioner is that the land of the petitioner is required by the respondents for Purvanchal Expressway, however, no acquisition has been made nor any compensation has been paid. 3. Learned Standing Counsel has placed on record the written instructions received from SDM, Dhanghata, Sant Kabir Nagar, according to which, there was some title dispute between the tenure holders and, therefore, U.P. Expressway Industrial Development Authority, which is constructing the road, could not obtain title over the subject land through mutual negotiations. Consequently, the respondents have initiated proceedings for acquisition under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Award, 2013. A notification under Section 11 of the Act was issued on 03.02.2024. It is also stated that a recommendation has been made for making correction in the said notification and it has been assured that the proceedings would be concluded expeditiously and, thereafter, compensation for the subject land shall be paid in accordance with law. 4. In view of the fact that the respondents have already initiated proceedings for acquisition, we are of the opinion that no further direction is required to be issued by this court. It is left open to the petitioner to stake his claim at appropriate stage before the Special Land Acquisition Officer, as stipulated under law. 5. The petition stands disposed of.
