Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. Instant application under Section 482 Cr.P.C. has been filed with the prayer to quash the impugned order dated 21.6.2024 passed by the Principal Judge, Family Court, Lucknow in Case No.493 of 2024, Versha Rani Verma and another Vs. Abhishek Prakash Rastogi. From perusal of the order sheet, it transpires that on 12.2.2025, the matter was referred to the Mediation and Conciliation Center whereupon the parties appeared and have settled their dispute while executing the settlement-agreement on 30.4.2025. The Mediator has also sent report on 30.4.2025 while appending the settlement-agreement with remarks of result as mediation completed and succeeded. From perusal of settlement/agreement, it transpires that the parties have settled their dispute and particularly with respect to criminal case the facts find mention in para 6H of the settlement-agreement dated 30.4.2025. Para 6H of the settlement-agreement dated 30.4.2025 is reproduced hereinunder:- "That the parties have agreed to withdraw/not press/not to pursue the cases filed against each other and their family member related to the present dispute. The details of the cases are as under:- (i) Case No.493 of 2024 Versha Rani Verma and another Vs. Abhishek Prakash Rastogi U/s 125 Cr.P.C. filed before Principal Judge, Family Court, Lucknow. (ii) Case No.3943 of 2023 U/S 13 of Hindu Marriage Act, pending before Family Court, Lucknow. (iii) Criminal Case No.13590 of 2018, Case Crime No.248 of 2017, U/S 147, 148, 452, 504, 506 I.P.C. pending before ACJM-V, Lucknow." Thus, the parties were agreed that they will withdraw/not press/not to pursue the cases filed against each other and their family member with respect to the dispute involved in aforementioned Case Crime No.493 of 2024, 3943 of 2023 and 13590 of 2018. Learned counsels appearing for the parties have also submitted that now the parties have settled their dispute and allowing further criminal proceedings against them would amount to abuse of process of law and, therefore, requested that the criminal proceedings against them may be quashed. Since the matter has been settled between the parties and the parties have settled their dispute by way of entering into settlement-agreement before the Mediation and Conciliation Centre of this Court, thus, the criminal proceedings of Case No.493 of 2024, Versha Rani Verma and another Vs. Abhishek Prakash Rastogi is hereby quashed. The settlement-agreement dated 30.4.2025 shall be part of this order. The application is allowed accordingly. Consigned to records.
