1. PUBLIC PROSECUTOR The Court made the following-.
ORDER: r=f3feSff
This Criminal Petition, under Sections 480 & 483 of the Bharatiya I. Nagarik Suraksha Sanhita, 2023, has been f'lled by the Petitioner/A.1, seeking regular bail, in crime No.36 of 2025 of Kovvur Town Police Station, East Godavari District. i
2. A case has been registered against the PetitiOn6r and others for the offences punishable under sections 121 (1 ), 109(1 ) r/w 3(5) of BNS.
3. The brief facts Of the Case are that On 14.02.2025 at 8.00 p.m., the complainant/police constable reported that he has been attend|lng duties at RS-12 Mobile, NH16, near Gaman India Toll plaza, Kovvur Town. The compla'lnant received information about a snatching incident at yerravaram village by culprits who came in a Mahindra Scorp'lo, and that Said Vehicle Was t.t` proceeding towards vijayawada side. upon receiving the said information, as per the instructions of his superior officers, the complainant along with HG 509/M.LaxmanaraO Were COnduCting Vehicle Checking at Gaman India Toll plaza, Kovvur Town. They found Seven Persons in the Mahindra Scorpio vehicle bearing No.AP40 AH 3920, which Was Proceeding towards the vijayawada side. on suspicion, the complainant and another officer tried to stop the said vehicle, but the accused attempted to kill the complainant by hitt'Ing him With their Vehicle and escaped. As a result, the COmPlainant fell on the road and sustained injuries to his body.
4. Heard learned counsel for the Pet-lt'lOner/A.1 and the learned Assistant public prosecutor representing the respondent/State. +-t -- .==--,=-,-st
Learned counsel for the petitioner/A.1 contends that this Court was pleased to grant bail to A.7 as per the orders passed in Criminal Petition No.2656 of 2025 dated119.03.2025. Perused the order passed in the said Criminal Petition.
6. Learned Assistant Public Prosecutor opposed to grant bail On the ground that investigation is not yet completed and there are antecedents against the petitioner.
7. As seen froin the record, the petitioner has been injudiCial custody from
14.02.2025. As seen from the allegations made, while the Petitioner along with six others were pro'6eeding in Mahindra Scorpio towards Vijayawada side, on suspicion, the complainant and other officers tried to stop the vehicle, but the driver of the said vehicle did not stop. As the petitioner was said to be travelling in the vehicle, learned counsel for the petitioner contends that the i, \ pet-ItiOner has nO role in not stopping the vehicle bythe driver.
8. Consideringlhe fact that most of the investigation Pertaining tO the role played by the petitioner in the commission Of the Offence might have been completed by this time ahd as the COmPlainant and Other Witnesses belong to police department, this Court finds that the release Of the Petitioner would not cause tampering of evidence and hampering of investigation. Considering the entire material on record, this court is inclined to grant bail to the petitioner/A.1 with some conditions. -i c,`-,irr~
