Neutral Citation No. - 2025:AHC-LKO:8356 Court No. - 16 Case :- CRIMINAL REVISION No. - 158 of 2025 Revisionist :- Rahul Kumar Opposite Party :- State Of U.P. Thru. Secy. Home Lko And Another Counsel for Revisionist :- Rehan Ahmad Siddiqui Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. The present revision under Section 19(4) Family Court Act has been preferred by the revisionist against the impugned judgement and order dated 13.1.2025 passed by learned Principal Judge Family Court Barabanki passed in Crl Case No.91 of 2022 whereby the application under Section 125 Cr.P.C. moved by the respondent no.2 has been partly allowed and the revisionist has been directed to pay Rs.4000/- per month to respondent no.2 from the date of filing of application dated 27.1.2022. Heard learned counsel for the revisionist and learned A.G.A. for respondent State. Notices to respondent no.2 is dispensed with in view of the proposed order. Perused the record. It is not in dispute that the respondent no.2 is the legally wedded wife of the revisionist. She is a destitute and unable to maintain herself. On the other hand, although the revisionist has adequate source of income to maintain himself or his wife, but has neglected to provide maintenance to respondent no.2, who has been living separately for sufÏcient cause and as such, considering these aspects, the impugned order dated 13.1.2025 (supra) has been passed by the learned court below. No interim maintenance was provided to respondent no.2 by the revisionist since the date of filing the application under Section 125 Cr.P.C. which was filed in the year 2022. I find no illegality in the order impugned. The revision, being devoid of merit, is accordingly dismissed.
