The instruction filed by learned Standing Counsel is taken on record. 2. Heard learned counsel for the petitioner and learned Standing Counsel. 3. The present petition has been filed with the following main relief:- "(i) Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties more specifically opposite parties No.1 to 3 to take necessary action against the opposite parties Nos.5 to 8 to get removed the illegal encroachment, made by him over the land of Gata No.724/0.0410 situated in Village- Ismail Ganj, Paragana- Godlamau, Tehsil- Sidhauli, District- Sitapur, who is recorded as village main Chak Marg land in revenue record." 4. Learned Standing Counsel, based on the instructions, states that the offending constructions have already been removed. The said fact has been disputed by learned counsel for the petitioner. 5. Considering the fact that the State has taken a stand that the offending constructions have been removed and the said fact has been disputed by learned counsel for the petitioner, the present petition is disposed of permitting the petitioner to file an appropriate application under Section 67 of the U.P. Revenue Code, 2006, in case the offending constructions are still standing, which shall be considered in accordance with law.
