This Application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing the entire proceedings of Criminal Case No.1468 of 2025, pending before the court of learned Additional Chief Judicial Magistrate/ Ist Additional Civil Judge (Senior Division), Rudrapur, District Udham Singh Nagar under Sections 118(1), 85 of the Bharatiya Nyaya Sanhita, 2023, Section 3 and Section 4 of the Dowry Prohibition Act, 1961. 2. Mr. Ankush Singhal, learned counsel for the applicants - accused. 3. Mr. Virendra Singh Rawat, learned Assistant Government Advocate for the respondent no.1. 4. Mr. Basant Singh, learned counsel for the 1 2025:UHC:9062 respondent no.2 - informant and the wife of the applicant no.1. 5. Applicant no.2 is the father, applicant no.3 is the mother, applicant no.4 is the brother and applicant no.5 is the sister of the applicant no.1. 6. All the applicants are present in-person. They are identified by Mr. Ankush Singhal, Advocate. 7. The respondent no.2 is present in-person. She is identified by Mr. Basant Singh, Advocate. 8. According to the applicants and the respondent no.2, there were matrimonial disputes. They have resolved their disputes. They have filed a Compounding Application (IA No.1 of 2025) and affidavits with their free will and without any pressure. Applicant no.1 and the respondent no.2 submitted that they are living happily. 9. The respondent no.2 has requested to quash the entire proceedings of the Criminal Case No.1468 of 2025. 10. The said request of the respondent no.2 has not been opposed by the respondent no.1. 11. Considering the totality of the matter, this Court is of the view that ends of justice would be met if the entire proceedings of Criminal Case No.1468 of 2025, pending before the court of learned Additional Chief Judicial Magistrate/ Ist Additional Civil Judge (Senior Division), Rudrapur, District Udham Singh Nagar, are quashed. 12. Resultantly, the present Application, filed under 2 2025:UHC:9062 Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and the entire proceedings of Criminal Case No.1468 of 2025, pending before the court of learned Additional Chief Judicial Magistrate/ Ist Additional Civil Judge (Senior Division), Rudrapur, District Udham Singh Nagar, are hereby quashed. ___________________ Date: 13.10.2025 ALOK KUMAR VERMA, J.
