The present petition has been filed by the petitioner challenging an order dated 30.01.2025 whereby the financial and administrative powers of the petitioner were seized pending enquiry. 3. The counsel for the petitioner argues that in terms of the final enquiry report submitted on 20.02.2025 contained in the counter affidavit, the petitioner has not been found guilty and no further action has been proposed against the petitioner, who is a Gaon Pradhan. 4. Considering the fact that final enquiry has already been concluded and no steps are being taken for removal of the Pradhan, the order dated 30.01.2025 passed under Section 95(1)(g) of the U.P. Panchayat Raj Act, which is empowered to be exercised during the pendency of the enquiry proceedings, cannot continue any further and is accordingly quashed. The financial and the administrative powers of the petitioner shall stand restored forthwith. In case, any other action is proposed or is pending, the same shall be concluded in accordance with law. 5. The petition is disposed of in terms of the above.
