Case No.90 of 2024, for offences under Sections 317(5), 3(5) of the Bharatiya Nyaya Sanhita and Section 21 of the Mines and Minerals (Development and Regulation) Act, 1957. The case is presently pending before the Court of learned S.D.J.M. Dhanbad. 2. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 3. Learned counsel representing the petitioner admits that from the impugned order, it reveals that notice under Section 35(3) of the BNSS has been issued. 4. Since notice under Section 35(3) of the BNSS has been issued to the petitioner, I am of the opinion that there is no imminent threat of the petitioner being arrested. 5. The petitioner should cooperate with the investigation by appearing before the Investigating Officer. 6. With the aforesaid observation, this Anticipatory Bail Application stands disposed of.
