Heard learned counsel for the petitioners and Shri Shiv prasad Kushwaha, learned counsel appearing for opposite party No.2. The petitioners allege digging on their land by the official opposite parties for the purpose of construction of Ganga Express Way. However, learned Standing Counsel has instruction provided by Tehsildar- Salon, District- Raebareli that no such digging has taken place on the land in possession of the petitioners. Let the District Magistrate, Raebareli get an on the spot inspection conducted by an officer not below the rank of Sub- divisional Magistrate, in whose jurisdiction the land of the petitioners does not fall, to ascertain as to whether any digging has taken place on their land or not. If it has taken place, then remedial measures shall be taken or compensation be paid, as the case may be. If it has not taken place, then the petitioners shall be informed about it along with inspection report. Let this exercise be completed within three weeks from the date of receipt of a certified copy of this order. The present petition is disposed of in the aforesaid terms. (Om Prakash Shukla,J.)
