Neutral Citation No. - 2025:AHC-LKO:8049 Court No. - 8 Case :- WRIT - B No. - 115 of 2025 Petitioner :- Vasudev Tirtha Dharmik Prabandh Committee, Amroha Thru. Chairman, Sri Shiv Swaroop Tandon Respondent :- Board Of Revenue For U.P., Lko. Thru. Chairman And Others Counsel for Petitioner :- Ram Raj,Gokul Seth,Hanumant Lal Srivastava,Radhika Singh,Rishabh Raj Counsel for Respondent :- C.S.C.,Pankaj Gupta Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of respondent no.1 has been accepted by the ofÏce of the learned Chief Standing Counsel. Shri Pankaj Gupta, Advocate has accepted notice on behalf of respondent no.2. The petitioner has approached this Court seeking quashing of the order dated 28.11.2024 passed by the Board of Revenue whereby after hearing the parties, the Board of Revenue directed the parties to maintain status quo fixing 17.2.2025. Submission of learned counsel for the petitioner is that the aforesaid revision was preferred alongwith an application under Section 5 of the Limitation Act. The revisional court by means of the order dated 30.9.2024 condoned the delay and admitted the revision for hearing fixing
28.11.2024. As noticed above, on 28.11.2024, the Board of Revenue directed the parties to maintain status quo and also called for record of the court below fixing 17.2.2025. Submission is that because of the status quo
order, certain maintenance work which was being done over the property in question in pursuance of some government scheme, has come to a stand still in light of an order which has been passed by S.D.M., Amroha dated 26.12.2024, a copy of which has been placed on record Annexure No.6. It is in the aforesaid circumstances, it is urged that the
order impugned is bad.
Having considered the aforesaid submissions and the undisputed facts that (i). the revision is still pending before the Board of Revenue and the next date fixed is 17.2.2025, (ii) It is also undisputed that the order of status quo has been passed on 28.11.2024 after hearing the parties. (iii). There is nothing on record to indicate that after the passing of the order dated 28.11.2024 any objection/ modification or vacation of the status quo order has been prayed for by the petitioner by moving an appropriate application before the Board of Revenue. As this matter is listed on 17.2.2025 before the Board of Revenue, hence, in case the petitioner has any grievance against the said order, it would always be open for the petitioner to bring his objections to the notice of the court concerned who needless to say, would consider and decide the same in accordance with law as expeditiously as possible. Thus for the aforesaid reasons, the petition is dismissed.
