The present Criminal Writ Petition, filed under Article 226 of the Constitution of India, has been instituted by the Petitioners- (1) Ankit Sah S/o Sri Basant Lal Sah, (2) Vikky Sah alias Vinay Sah S/o Lacchi Lal Sah, (3) Chandan Nainwal alias Mohan Chandra Nainwal S/o Sri Keshav Datt Nainwal, (4) Tanni alias Tarun Thakur S/o Sri Harish Singh, (5) Suresh Joshi alias Suresh Chandra Joshi S/o Sri Amba Datt, (6) Pawan Bhatt alias Pawan Chandra Bhatt S/o Sri Kailash Chandra Bhatt, (7) Hittu Sah alias Hitesh Sah S/o Sri Basant Lal Sah, (8) Gopal Gariya alias Gopal Singh S/o Sri Pratap Singh, (9) Bharat Nainwal S/o Sri Rajendra Chandra Nainwal, (10) Bhaskar Pandey alias Bhagwan Chandra S/o Sri Gopal Datt, (11) Pushkar Singh Panaura S/o Sri Ganga Singh Panaura, (12) Leela Ram S/o Sri Jas Ram, (13) Jamuna Dutt Katyura S/o Sri Keshab Datt Katyura, (14) Rajendra Mehra alias Rajendra Singh S/o Sri Anand Singh, and (15) Kailash Negi alias Kailash Singh S/o Sri Jeewan Singh, against the Respondents, particularly Respondent No. 4, with the following prayer:

“(i) Issue a writ, order or direction in the nature of Certiorari, quashing the impugned F.I.R. No. 0011 of 2025 dated 15.08.2025, registered under Sections 109, 118(1), 191(2), 191(3), 3(5), 310(2), 351(2), 351(3), and 352 of the Bharatiya Nyaya Sanhita, 2023, Police Station Betalghat, District Nainital, lodged by Respondent No. 4 against the Petitioners.”
5. Today, the matter is listed for disposal of the Compounding Application (I.A. No. 01 of 2025, Paper No. 35), filed jointly by the parties seeking permission to compound the offences on the ground that they have amicably settled their dispute. 6. The application has been duly signed by both sides and endorsed by their respective learned counsel — Mr. T.P.S. Takuli, learned counsel for the Petitioners, and Mr. Akhil Kumar Sah assisted by Mr. Ayush Agrawal, learned counsel for Respondent No. 4. Affidavits in support of the application have also been filed. 7.
Learned State Counsel opposes the Compounding Application on the ground that some of the offences alleged are non-compoundable in nature. 8. The Petitioners and Respondent No. 4 are present in person before this Court and have been duly identified by their respective counsel. 9. It appears that the dispute between the parties arose out of an incident that took place during the election of the Block Pramukh, Betalghat Block, District Nainital. The matter was primarily political in nature, and cross-cases
2025:UHC:9040 were registered by both sides arising out of the same occurrence. 10. The parties now state before this Court that they have amicably resolved their dispute outside the Court and wish to maintain cordial relations in future. 11. In view of the statements made before this Court and considering that the compromise has been entered into voluntarily and without any coercion, duress, or undue influence, the Court finds no impediment in accepting the same. 12. Considering the overall facts and circumstances of the case and the nature of the offences involved, the Compounding Application (I.A. No. 01 of 2025) is allowed. The compromise between the parties is accepted. 13. Consequently, the First Information Report dated 15.08.2025, registered as F.I.R./Case Crime No. 0011 of 2025, under Sections 109, 118(1), 191(2), 191(3), 3(5), 310(2), 351(2), 351(3), and 352 of the Bharatiya Nyaya Sanhita, 2023, Police Station Betalghat, District Nainital, is hereby quashed, insofar as it relates to the present Petitioners, in terms of the compromise. 14. The Criminal Writ Petition stands disposed of accordingly. 15. All pending applications, if any, also stand disposed of. (Ashish Naithani, J.)
